A man who allegedly trespassed on his estranged wife’s property saw his charges dismissed today.
Dennis Davis, 56, pleaded not guilty to entering the land of Penelope Davis and disobeying a written notice forbidding him to do so.
The court heard Mrs Davis is Mr Davis’s estranged wife who lives on the property. Mr Davis told the court he owned the property with his wife but they had been separated for 16 years.
He also said he wasn’t aware of a notice to stay away from the property and said he was trying to get a divorce sorted so that they could settle the property.
Senior Magistrate Archibald Warner decided to dismiss the information and said: “You have now been served. The purpose of service is simply to make you aware that you shouldn’t go on the property.
“You should stay away from there until it’s settled.”
Mr Davis said: “I understand that now”.
