A 48-year-old man appeared in court this morning charged with riding a pedal cycle while impaired.
But the charges were never put to Dion Burgess because Senior Magistrate Archibald Warner questioned the validity of them.
Crown counsel Loxly Ricketts told the court that you could be charged for driving a pedal cycle while impaired under current legislation.
But Mr Warner said: "You are saying not only is it written here but it was the intention of Parliament to include other vehicles?"
Mr Ricketts said Mr Burgess should be charged for the offence, especially because he was involved in a collision wtht a car in this situation.
Mr Warner decided to dismiss the matter.
He said: "Let me put this over and you can do the necessary research and come back.
"What I suggest is that you withdraw this information formally. If you withdraw, there's nothing wrong with reinstating it within six months if you are correct. "
Mr Ricketts agreed and the charges were dismissed against Mr Burgess.
