A 24-year-old man today admitted driving while over the legal limit and causing an accident that left a girl with a broken leg.

Magistrates’ Court this morning heard Mikai Fubler was involved in collision at 11:30pm on June 25 at the junction of Tee Street and South Road.

When police officers arrived, they saw a female bike rider in the road. She appeared to be in severe pain and her leg was deformed. She was later identified as Diara Benjamin.

The driver of the car had left the scene.

A few minutes later, Fubler came to the scene of the accident and identified himself as the driver.  

When officers were speaking to him, they noticed his eyes were glazed and his breath smelled of alcohol.

The officers asked Fubler if he had been drinking. He told them he had an Elephant beer and a half a shot of Chivas.

Fubler was arrested and said: “I just want to know that the girl’s alright”.

He was taken to the Hamilton Police Station where he gave samples of breath for analysis.

The analysis showed Fubler had 105 miligrams of alcohol in 100 mililitres of blood. The legal limit is 80.

Senior Magistrate Archibald Warner gave Fubler a $2,000 fine and a two-year driving ban.

 

Fubler denied causing grievous bodily harm to Ms Benjamin while being impaired, but admitted causing grievous bodily harm to her while driving a car while over the legal limit.
