A man who admitted sitting in the driver’s seat of a car while drunk on Good Friday was today convicted but allowed to drive his work truck.
Levar Jones, 35, admitted having care and control of a vehicle while his ability was impaired on March 29.
He denied refusing to give a sample of his breath.
The court heard officers on duty in St David’s saw Jones in a parked car in a bus stop.
He was sleeping in the front seat. Officers woke him up and asked if he had been drinking.
Jones told the officers he had but said he wasn’t the driver of the car.
He was arrested and refused to participate in a breathalyser test.
In court today, Jones told Senior Magistrate ArchibaldWarner his sister was driving the car from St David’s Cricket Club when she had to go back because of an issue with her boyfriend.
Jones said she parked the car in a bus stop and he moved to the driver’s seat in case the car needed to be moved.
He said he never drove the car.
Jones also told the court he drives heavy truck for Dunkley’s Dairy.
Duty counsel Charles Richardson argued Jones shouldn’t be disqualified from driving because he wasn’t driving the car.
“I’m submitting to you that the only reason he entered the vehicle was just in case he had to move it.”
Mr Warner agreed with Mr Richardson and used his discretion to disqualify Jones from all vehicles except a heavy truck for work.
