(LAND-HOLDING CHARGES) AMENDMENT REGULATIONS 2008
The Minister responsible for immigration, in exercise of the powers conferred by section 102C (1)(a) of the Bermuda Immigration and Protection Act 1956, makes the following Regulations:
Citation
1 These Regulations may be cited as the Bermuda Immigration and Protection (Land-Holding Charges) Amendment Regulations 2008.
Amends Schedule
2 The Schedule to the Bermuda Immigration and Protection (Land-Holding Charges) Regulations 2007 is amended by deleting the last two entries respecting land-holding charges payable by “any” restricted person and substituting the following —
“Any Tourist accommodation Any, other than by
that is not a residential devise, inheritance
valuation unit or voluntary
conveyance
(a)on first disposition 10% of the value
from the developer of the land
(b)on any other disposition 15% of the value
of the land
Any Any, other than land of Any 5% of the value
a type referred to above of the land.”.
Transitional provision
3 (1) The Minister shall issue a refund to any restricted person who paid a land-holding charge, during the period beginning on 1 July 2007 and ending on the date of the coming into operation of these Regulations, in respect of the first disposition from Belmont Hills Development Limited of a share or fraction in a unit at the Belmont Hills Golf Resort & Spa, 27 Harbour Road, Paget, Bermuda.
(2) The refund shall be in an amount that is equal to one-third of the land-holding charge that was paid.

Amends Schedule
2 The Schedule to the Bermuda Immigration and Protection (Land-Holding Charges) Regulations 2007, as amended by the Bermuda Immigration and Protection (Land-Holding Charges) Amendment Regulations 2008, is amended —
(a) by deleting the figure 22% and substituting the figure 25%; and
(b) by deleting the figure 15% wherever it appears and substituting the figure 18%.
Commencement
3 These Regulations shall come into operation on 1 April, 2008.

2 The DataMaster DMT, an instrument designed to receive and make analysis of a sample of the breath of a person in order to measure the proportion of alcohol in the blood of that person, is approved as an “approved instrument” for the purposes of the Road Traffic Act 1947.

2 Regulation 2 of the Merchant Shipping (Fees) Regulations 2007 is amended by revoking the definition of “tons” and substituting the following definition —
“"tons" means net tonnage.”.

The Minister responsible for financial assistance, in exercise of the powers conferred upon him by section 21 of the Financial Assistance Act 2001, makes the following Regulations:
Citation
1 These Regulations, which amend the Financial Assistance Regulations 2004 (“the principal Regulations”), may be cited as the Financial Assistance Amendment Regulations 2008.
Amends regulation 2 of the principal Regulations
2 Regulation 2(1) of the principal Regulations is amended by inserting, next after paragraph (e) in the definition of “excluded income”, the following paragraph —
“(f) in relation to persons suffering from mental disorder who are resident in private residential accommodation, earnings to an amount not exceeding $500 per calendar month;”.
Amends regulation 3A of the principal Regulations
3 Regulation 3A(1) of the principal regulations is amended —
(a) in paragraph (c), by deleting the word “and”;
(b) in paragraph (d), by inserting next after the semi-colon the word “and”; and
(c) by inserting next after paragraph (d), the following paragraph —
“(e) persons aged 18 to 21 years who were foster children under the Children Act 1988 and who continue to reside in the household of a former foster parent;”.

Substitution of Schedule
2 The Schedule to the Government Fees Regulations 1976 is revoked and the Schedule to these Regulations is substituted for it.
Commencement and transitional
3 (1) Subject to paragraph (2), these Regulations come into operation on 1 April 2008.
(2) Nothing in these Regulations affects the validity of a fee that is paid before the coming into operation of these Regulations.
