Hospitals board could be sued for millions in court of appeal

A German quadriplegic has won an appeal to sue Bermuda Hospitals Board for negligence.

Thomas Hofer claims he broke his neck while under the care of St. Brendan's Hospital, which is now the Mid Atlantic Wellness Institute, in 1994.

Mr. Hofer was taken to St. Brendan's Hospital for psychiatric treatment on February 10 but three days later was admitted to hospital with a broken neck.

His legal team says he suffered the injury when he fell from his bed while under the care of the psychiatric hospital.

Mr. Hofer's case was originally struck out by the Supreme Court in 2008 for excessive delay.

But yesterday Court of Appeal judges upheld an appeal by Mr. Hofer's legal team for the case to be re-instated and go to trial.

A trial is likely to take place later this year and Mr. Hofer, who now lives in Germany as a ward of the German state, stands to win millions of dollars in damages if the case is successful.
