The 2012/13 annual re-licensing period for commercial fishing vessel licenses will end, on FRIDAY, MARCH 30, 2012.
All commercial fishing vessels must be inspected and approved for compliance with the Marine Board (Safety) Regulations prior to re-licensing.
Owners of fishing vessels who have not yet had their vessels inspected should come to the Licensing Office of the Department of Environmental Protection, Botanical Gardens, Paget by 5:00 p.m. on Friday, March 30, 2012, to request a deferred inspection date from the Commercial Fisheries Council (CFC).
Fishing vessel licenses not renewed by the deadline will revert to the Department.

MERCHANT SHIPPING (FEES) REGULATIONS 2012

The Minister responsible for Maritime Administration, in exercise of the powers conferred under section 250 of the Merchant Shipping Act 2002, makes the following Regulations:
Citation
1These Regulations may be cited as the Merchant Shipping (Fees) Regulations 2012.
Interpretation
2In these regulations—
“Act” means the Merchant Shipping Act 2002;
“tons” means net tonnage;
“travelling time” includes the time taken to travel from Bermuda to a work location outside Bermuda subject to a maximum of 10 hours in any 24 hour period;
“work location” means any ship, company office, shipyard or other location where the services, described in these Regulations, are performed.
Application
3(1)Nothing in these Regulations shall apply to any service started before the date on which these Regulations come into operation, and as respects any such service the fee payable shall be that applicable at the time of starting the service.
(2)The fees set out in the Schedule to these Regulations shall apply in respect of any service started on or after the date on which these Regulations come into operation.
(3)Where a fee is determined by the amount of work involved on or off the ship—
(a)travelling time in excess of one hour for each visit to a ship in Bermuda shall be disregarded;
(b)the travel and subsistence costs incurred in visiting a work location outside Bermuda shall be charged in addition to the hourly rate;
(c)where the work carried out in conjunction with work for which fees are not payable under these Regulations, the fee is to be determined by reference to the time taken to ensure compliance with the requirements for which fees are charged under these Regulations; and;
(d)any specific costs incurred in respect of outside services shall be charged additionally to the hourly rate.
Fees
4The fees specified in the Schedule to these Regulations shall be the fees payable for the services in relation thereto.
Revocation
5The Merchant Shipping (Fees) Regulations 2007 are revoked.
SCHEDULE
(regulation 4)
PART I
SURVEYS, INSPECTIONS AND APPLICATIONS FOR EXEMPTION
1In this Part of the Schedule, “statutory requirement” means any provision of the Act as it applies to Bermuda and any regulation made thereunder in respect of surveys, inspections and applications for exemption relating to any statutory certificate issued by the Department of Maritime Administration or on behalf of the Department of Maritime Administration.
2Subject to any additional charge payable under Part III of this Schedule, the fees for the services in this Part of the Schedule shall be determined by the amount of work involved, charged at an hourly rate of $165.00.
Application of Part I
3Subject to paragraph 4, the services and other functions to which this Part applies are—
(a)a survey or inspection of a ship or its equipment or any audit of its management systems, its security provisions or the arrangements for seafarers on the application of the owner, for the issue, amendment, endorsement or renewal of a certificate for the purpose of showing compliance with any of the statutory requirements;
(b)any other inspection of a ship or its equipment under section 219(1) of the Act (powers to inspect ships and their equipment) on the application of the owner, for the purpose of seeing that the ship complies with any of the statutory requirements;
(c)an audit of a company management office for the issue, amendment, endorsement or renewal of a certificate for the purpose of showing compliance and statutory requirements;
(d)an inspection or audit under section 219(1) of the Act, otherwise than on the application of the owner, for the purpose of seeing whether or not the statutory requirements have been complied with;
(e)an inspection of a ship in response to a crew complaint where the substance of the complaint is found to be proven;
(f)an inspection, survey or audit of the ship, its equipment or management, whether on the application of the owner or otherwise, where—
(i)the ship or any of its equipment subject to the statutory requirements has been damaged, changed or modified;
(ii)a previous inspection has revealed a failure to comply with any of those statutory requirements; or
(iii)the Minister has reasonable grounds to believe that the condition of the ship or its equipment is not in compliance with the statutory requirements or that the ship is no longer suitable to be a Bermuda ship;
(g)the consideration of an application for an exemption or approval or an amendment of an exemption or approval pursuant to any of the statutory requirements;
(h)the consideration of an application for equivalence pursuant to any of the statutory requirements;
(i)an inspection pursuant to the statutory requirements which results in the detention of a ship and any subsequent inspection relating to the deficiencies which led to the detention;
(j)the issue or re-issue of a certificate pursuant to the statutory requirements; and
(k)the tonnage measurement of any ship or yacht.
4Where a fee is specifically prescribed under another Part of this Schedule in respect of a survey, inspection or audit or the issue or endorsement of a certificate in connection with any of the statutory requirements, the fee so prescribed applies and not the fee prescribed under this Part.
PART II
ADDITIONAL CHARGES
1Waiting time—
Fees in respect of waiting time incurred during a survey, inspection or audit undertaken outside Bermuda shall be charged at the rate of $165.00 per hour, with a maximum number of seven hours in any 24-hour period being accountable.
Saturday, Sunday or Public Holiday—
2Fees for services undertaken on a Saturday, Sunday or Public Holiday, shall be determined by the amount of work involved, charged at an hourly rate of $330.00, with a maximum number of seven hours in any 24-hour period being accountable.

Revokes and replaces Schedule
2The Schedule to the Government Fees Regulations 1976 is revoked and replaced with the Schedule to these Regulations.

3Nothing in these Regulations affects the validity of a fee that is paid before the coming into operation of these Regulations.

The Minister of Finance, in exercise of the power conferred by section 2 of the
Government Fees Act 1965, makes the following Regulations:
Citation
1These Regulations may be cited as the Government Fees (Trade Marks and Service Marks) Amendment Regulations 2012.
Revokes and replaces Schedule
2The Schedule to the Government Fees (Trade Marks and Service Marks) Regulations 1993 is revoked and replaced by the Schedule to these Regulations.
Transitional
3Nothing in these Regulations affects the validity of a fee that is paid before the coming into operation of these Regulations.
Commencement
4Subject to regulation 3, these Regulations come into operation on 1 April 2012.

The Minister responsible for health, in exercise of the power conferred by section 13A(4)(b) of the Bermuda Hospitals Board Act 1970, makes the following Order:
Citation
1This Order may be cited as the Bermuda Hospitals Board (Medical and Dental Charges) Order 2012.
Interpretation
2In this Order—
“specialist” means a person designated as such by the Medical Staff Committee of the Bermuda Hospitals Board;
“unit” means a unit in the scale of fees prepared by the Minister under section 13A(1) of the Bermuda Hospitals Board Act 1970.
Dollar value of units
3For the purposes of section 13A(4)(b) of the Bermuda Hospitals Board Act 1970—
(a)in relation to the type of practitioner listed in the Schedule hereto, the dollar value of each unit shall be as set out in the Schedule; and
(b)in relation to a dental practitioner, the dollar value of units shall be in accordance with the Ontario Dental Association 2012 Fee Schedule.

The Minister responsible for health, in exercise of the power conferred by section 13(2) of the Health Insurance Act 1970, makes the following Order:
Citation
This Order may be cited as the Health Insurance (Health Insurance Plan) (Premium) Order 2012.
Premium
2The premium (including the standard premium) to be paid to the Committee in respect of each health insurance plan effected with the Committee under the Act shall be $390.00 a month (or $90.00 a week where paid weekly).
Revokes BR 11/2011
3The Health Insurance (Health Insurance Plan) (Premium) Order 2011 is revoked.
Commencement
4This Order comes into operation on 1 April 2012.

HEALTH INSURANCE (FUTURECARE PLAN) (PREMIUM) ORDER 2012

The Minister responsible for health, in exercise of the power conferred by section 13B of the Health Insurance Act 1970, makes the following Order:
Citation
1This Order may be cited as the Health Insurance (FutureCare Plan) (Premium) Order 2012.
Premium for persons who qualify for subsidy
2The premium (including the standard premium) to be paid to the Committee in respect of each FutureCare plan effected with the Committee under the Act for persons over the age of 65 who qualify for subsidised hospital treatment under section 2(1) of the Act shall be—
(a)in the case of a person who was enrolled in the FutureCare plan immediately before 1 April 2010, $385.00 a month (or $88.85 a week where paid weekly);
(b)in the case of a person who was not enrolled in the FutureCare plan immediately before 1 April 2010, and who attained the age of 65 years after 1 January 2009 but before 1 April 2010, $385.00 a month (or $88.85 a week where paid weekly); and
(c)in the case of a person who has attained the age of 65 years but to whom paragraphs (a) and (b) do not apply, $635.00 a month (or $146.54 a week where paid weekly).
Premium for persons who do not qualify for subsidy
3The premium (including the standard premium) to be paid to the Committee in respect of each FutureCare plan effected with the Committee under the Act for persons over the age of 65 who do not qualify for subsidised hospital treatment under section 2(1) of the Act shall be $1,086.44 a month (or $250.72 a week where paid weekly).
Revokes BR 10/2011
4The Health Insurance (FutureCare Plan) (Premium) Order 2011 is revoked.
Commencement
5This Order comes into operation on 1 April 2012.

The Minister responsible for health, acting on the recommendation of the Bermuda Health Council, in exercise of the powers conferred by section 40(1) of the Health Insurance Act 1970, makes the following Regulations:
Citation
1These Regulations, which amend the Health Insurance (Standard Hospital Benefit) Regulations 1971 (“the principal Regulations”), may be cited as the Health Insurance (Standard Hospital Benefit) Amendment Regulations 2012.
Amends regulation 9
2Regulation 9 of the principal Regulations is amended by—
(a)deleting “$252.27” and substituting “$271.61”;
(b)deleting “$58.22” and substituting “$62.68”;
(c)deleting “$26.81” and substituting “$34.88”; and
(d)deleting “$6.19” and substituting “$8.05”.
Amends regulation 10
3Regulation 10 of the principal Regulations is amended by—
(a)deleting “$1,009.08” and substituting “$1,086.44”;
(b)deleting “$232.86” and substituting “$250.72”;
(c)deleting “$26.81” and substituting “$34.88”; and
(d)deleting “$6.19” and substituting “$8.05”.
Amends regulation 11
4Regulation 11 of the principal Regulations is amended by—
(a)in paragraph (1)(a)(i), deleting “$126.14” and substituting “$135.81”;
(b)in paragraph (1)(a)(ii), deleting “$29.11” and substituting “$31.34”;
(c)in paragraph (1)(b)(i), deleting “$504.54” and substituting “$543.22”; and
(d)in paragraph (1)(b)(ii), deleting “$116.43” and substituting “$125.36”.
Amends regulation 12
5Regulation 12 of the principal Regulations is amended by—
(a)in paragraph (1)(a), deleting “$29.11” and substituting “$31.34”; and
(b)in paragraph (1)(b), deleting “$116.43” and substituting “$125.36”.
Commencement
6These Regulations come into operation on 1 April 2012.

ROAD CLOSURE FOR
BARKERS HILL, DEVONSHIRE PARISH
This Ministry wishes to inform motorists there will be a road closure on Barkers Hill from Vesey Street entrance to the junction at North Shore Road and Barkers Hill Roundabout to allow for the Ross “Blackie” Talbot, Charity Classic event.
All vehicular access will be restricted along Barkers Hill, except for spectators vehicles which will be directed along this closed road by organizers of this event.
This road closure is effective from 9 am and will be completed by 4 pm on Saturday 7th April, 2012.
This Ministry apologizes for any inconvenience for the road closure, and request that motorists cooperate with the traffic control devices in this area.

MISSION ROAD, PAGET PARISH
REINSTATING THE NO PARKING RESTRICTION
The Ministry of Public Works wishes to inform the motoring public that Mission Road, Paget will become a No Parking zone for all motorized vehicles effective Tuesday, 3rd April, 2012 at 10.30am.
The Minister of Public Works will be carrying out road works in accordance with The Road Traffic Act 1947, Section 4 for Highways and Estates Roads. As well as carry out the vehicle parking changes according to the parking restriction mentioned in the Road Traffic Act 1947, Section 13, and Section 14.
This work is part of reinstating the No Parking road markings on Mission Road that were altered.
Should there be any questions regarding the No Parking on Mission Road please direct queries to the attention of the Ministry of Public Works, Mr. Curtis J. Charles, Construction and Maintenance Engineer at 297-7859.
