TENDER NOTICE
INFRASTRUCTURE EXPANSION & HOUSING PROJECT
FOR THE WEST END DEVELOPMENT CORPORATION
On Monday, 2nd July 2012 from 6:00pm – 8:00pm a pre-bid meeting will be held in the victualling yard (under the tent), in the Royal Naval Dockyard and is open to all members of the construction industry.
The purpose of the pre-bid meeting is to provide information for upcoming construction tenders. These tenders are related to the new infrastructure expansion and the housing project being undertaken by the West End Development Corporation.
Details will be provided about the tender packages (scope), tentative schedule of tenders and the process that will be taken to distribute the tenders. Also discussed will be the competitive process utilized to determine the best value for Wedco in the selection and awarding the work.
All potential contractors must furnish a full company profile on the night or email to: adias@wedco.bm by Monday, 2nd July 2012.

Mr. James Arnett Llewellyn Peniston was charged on a single complaint containing nine counts of improper conduct contrary to section 17 of the Bermuda Bar Act 1974 as read with Rules 4, 5, and 6 (ii),(iii) and (iv) of the Barrister’s Code of Professional Conduct 1981. The complaint was heard and determined by a Disciplinary Tribunal appointed under section 19 of the Bermuda Bar Act. On Monday 5th December 2011, the Disciplinary Tribunal found Mr. Peniston guilty of six (6) counts of improper conduct (e.g. dishonesty and failing to observe professional ethics and etiquette) as charged in the complaint by Irma Burrows. The complaint included, inter alia, Mr. Peniston’s conducting himself in a manner likely to impair his client’s trust in him; his failure to be competent, diligent and efficient in all his professional duties and his failure to maintain sufficient balances in his trust accounts to meet all his obligations (Rule 3(9) of the Accounts and Records Rules). The remaining three (3) other counts were dismissed.
Pursuant to Rules 18 (3)(b) and 20 (2) (a) of the Bar Disciplinary Tribunal Rules 1997, on Friday 6th January 2012, it was ordered that Mr. James Arnett Llewellyn Peniston be disbarred and struck-off the roll of barristers and attorneys.
Mr. Peniston appealed the Court of Appeal for Bermuda on Wednesday 28th December 2011. The Court of Appeal dismissed the appeal for want of prosecution on Thursday 7th June 2012. As such, Mr. James Arnett Llewellyn Peniston is hereby disbarred and struck-off the roll of barristers and attorneys.

Mr. James Arnett Llewellyn Peniston was charged with three separate complaints of improper conduct within the meaning of 17(1) of the Bermuda Bar Act. The complaints were heard by a Disciplinary Tribunal appointed under section 19 of the Bermuda Bar Act 1974. On Friday 9th December 2011, Mr. Peniston pled guilty to the charge of practising while suspended. The Disciplinary Tribunal found Mr. Peniston guilty of failure to maintain accounting records and issuing threats.
Pursuant to Rule 20(2)(b) of the Bar Disciplinary Tribunal Rules 1997, the Disciplinary Tribunal suspended Mr. Peniston from practice for a period of two (2) years on the charge of practicing while suspended as well as a further suspension of two (2) years for failing to maintain his accounting records, which will run currently with the previous charge. Pursuant to Rule 20(2)(g) of the Bar Disciplinary Tribunal Rules 1997, Mr. Peniston was formally reprimanded for issuing threats.
Mr. Peniston then appealed the Court of Appeal for Bermuda on Wednesday 28th December 2011. The Court of Appeal dismissed the appeal for want of prosecution on Thursday 7th June 2012. The decision of the Bar Disciplinary Tribunal remains.
