The Minister responsible for marine and ports services, in exercise of the powers conferred by section 10(1)(a), (aa) and (b) of the Marine Board Act 1962, regulation 5 of the Power-Craft Regulations 1960, and paragraph 4 of the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001, issues the following Notice:

Citation

1This Notice may be cited as the Marine Board (Control Over Maritime Traffic) Notice 2012.

Interpretation

2In this Notice—

“waters of Ferry Reach” means all that area of waters of Ferry Reach from the airfield landing light pylons close to the Bermuda Institute of Ocean Sciences thence westwards along the Reach to a line extending from the north side of the Reach to Little Roque Island thence to the eastern edge of Roque Island thence south eastwards to Stone Crusher Corner at Kindley Field Park.

Water-skiing permitted on certain Saturdays

3Persons may water-ski in the waters of Ferry Reach every Saturday commencing 21 April 2012 and ending 26 May 2012 during the hours beginning 8:00 a.m. and ending at 12:00 p.m.

Restrictions on water-skiing shall not apply

4The Power-Craft Regulations 1960 apply save that regulation 5(2)(b), which prohibits the operation of a power-craft for water-skiing and similar purposes within 200 feet of any foreshore, shall not apply to persons operating a power-craft for the purposes of towing persons on water-skis in accordance with paragraph 3 above.

Speed limits shall not apply

5Paragraph 3 of the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001, which provides a speed limit for persons navigating a boat within 100 metres of the shoreline of Ferry Reach, shall not apply to persons operating a power-craft for the purposes of towing persons on water-skis in accordance with paragraph 3 above.

Persons to exercise caution

6The owner, pilot, or operator of a boat, or any other person, is required to exercise extreme caution when navigating the waters near Ferry Reach during the period designated for water-skiing.
