DESIGNATION OF THE DIRECTOR OF CIVIL AVIATION OF BERMUDA

BY THE GOVERNOR OF BERMUDA

This Designation is made by virtue of Article 153 of the Air Navigation (Overseas Territories) Order 2007 (as amended) (“the AN(OT)O”), Article 26 of the Air Navigation (Overseas Territories) (Environmental Standards) Order 2004 (“the AN(OT)(ES)O”) and in accordance with advice received on 5 August 2011 from Air Safety Support International Limited (“ASSI”) pursuant to Article 153(3) of the AN(OT)O. The Designations made reflect the requirements of paragraph 3a of the Directions issued by the Secretary of State of January 2003, as amended, pursuant to his powers under Section 6(2), (b), (c) and (d) of the Civil Aviation Act 1982 and the obligation of the United Kingdom to ensure the implementation of the Standards and Recommended Practices issued by the International Civil Aviation Organisation in the Annexes to and pursuant to the Convention on International Civil Aviation (“the Convention”) done in Chicago on 7 December 1944 in respect of the Overseas Territories. The Designations made relate to the specific requirements of the said Annexes to the Convention as reflected in the Orders.

The Designation given excludes the power to make Rules of the Air as provided in article 37(1) of the AN(OT)O and the exercise of the Governor’s functions under Articles 113(1), 152(1)(a) and 154 of the AN(OT)O.

In respect of those responsibilities of the Governor described in Article 155 of the AN(OT)O this Designation is made solely for the purposes of regulatory oversight of the services. A delegation has been made separately in respect of ensuring the provision of those services.

In respect of Annex 5 (Units of Measurement to be Used in Air and Ground Operations) to the Convention, for which there are no specific powers exercisable by me at present contained in the AN(OT)O, a Designation cannot be made. I therefore request ASSI to advise me on the suitability of the arrangements made by the Director of Civil Aviation for Bermuda, or other body or agency, for the fulfilment of the requirements of this Annex. 

In respect of Annexes 9 (Facilitation) and 17 (Security: Safeguarding International Civil Aviation Against Acts of Unlawful Interference) to the Convention, the Department for Transport retains responsibility for determining the level of compliance with the requirements of these Annexes and there are no specific powers exercisable by me contained in the said Orders. Therefore, a Designation cannot be made.

I hereby designate the Director of Civil Aviation for Bermuda for the purposes of the said Orders, and of any Order amending or replacing those Orders, (other than for the purpose of Articles 37(1), 113(1), 152(1)(a) and 154 of the AN(OT)O or any Article amending or replacing those Articles), to exercise all functions for which I am responsible subject to the limitations described above.

This Designation shall come into effect on: 12 August 2011 and replaces any previous Designation made by me.

The Minister responsible for marine and ports services, in exercise of the powers conferred by section 10(1)(a), (aa) and (b) of the Marine Board Act 1962, issues the following Notice:

Citation

1 This Notice may be cited as the Marine Board (Control Over Maritime Traffic) (No. 4) Notice 2011.

Round-the-Island Boat Race

2 The Round-the-Island Boat Race (“the Race”) will take place on Sunday, 14 August 2011 from 1:55 p.m. to 3:30 p.m.

Closure of certain sea passages

3 On the day of the Race, the following sea passages will be closed to normal marine traffic at the following times—

(a) the passage between the pylons at the entrance to Ferry Reach will be closed from 12:00 noon to 3:30 p.m.; and

(b) the passage between Hinson’s Island and the Paget shoreline will be closed from 1:40 p.m. to 2:40 p.m.

Course for the Race

4 The course for the Race will be from Ferry Reach along the North Shore to Hog Fish Beacon to Two Rock Passage through Hamilton Harbour to Granaway Deep to Port Royal Bay to Great Sound to Commissioner’s Point and along the South Shore as far as St. David’s Head to St. Catherine’s Point and along the North Shore to finish in Ferry Reach.

Patrol of the course

5 The sea passages and the Race course referred to in this Notice will be patrolled by Marine Police and Marshall boats and all mariners, pilots and boatmen are required to exercise extreme caution when navigating in the proximity of the Race course particularly in the vicinity of Ferry Reach, Hog Fish Beacon, Two Rock Passage, and White’s Island in Hamilton Harbour.

Speed limits not to apply

6 During the Race, the speed limits fixed by the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001 do not apply to persons and boats participating in the Race.

Postponement of the Race

7 In the event of inclement weather, the Race will take place on Sunday 28 August 2011 from 1:55 p.m. to 3:30 p.m., and the provisions of this Notice apply to the Race held on that date.

SATURDAY 13th AUGUST 2011 1pm -8pm

CURVING AVENUE PEMBROKE PARISH

The Ministry of Public Works wishes to inform motorists that the section of Curving Avenue between the Curving Avenue bakery and the junction with St Augustine Road will be closed on Saturday 13th August 2011 between 1pm and 8pm. The closure is necessary to allow a block party to take place.

Traffic affected by this closure will be diverted via King Street, Parsons Road and St Augustine Road.

The Ministry of Public Works wishes to encourage the full cooperation of the motoring public and apologizes for any inconvenience that may result.
