PUBLIC NOTICE

Pursuant to section 21 of the Regulatory Authority Act, 2011 (RAA) the Minister of Justice, as the Chair of the Selection Committee (s.20 of the RAA) seeks applications for three positions of Commissioner within the newly established Board of Commissioners to whom the Chief Executive Officer of the Regulatory Authority (RA) will report. 

The Board of Commissioners will consist of three Commissioners who will each be voting members, and one of whom will serve as Chair.  The initial Commissioners will be appointed as follows, one for a term of two years; one for a term of three years; and one for a term of four years.

The Board of Commissioners will initially be responsible for regulating the electronic communications industry sector, other than broadcasting.  The principal functions and general powers of the Regulatory Authority are found in sections 12 and 13 of the RAA and include, but are not limited to:

i.establishing technical standards for the provision of covered services;

ii.reviewing and, as appropriate, approve, reject or modify tariffs filed by a sectoral provider governing the provision of covered services;

iii.establishing and enforce quality of service standards applicable to covered services;

iv.defining relevant markets, assess the competitiveness of relevant markets and identify sectoral providers that have significant market power in such markets;

v.adopting remedies to deter anti-competitive conduct by sectoral providers in any relevant market;

vi.modifying or find to be void, agreements involving one or more sectoral providers that unreasonably restrict competition in any relevant market;

vii.reviewing and, as appropriate, approve or reject proposed concentrations involving a specified sectoral provider; and

viii.prohibiting unfair trade practices by sectoral providers in any relevant market.

This notice serves as a public request for applications from persons who seek to be considered for the position of Commissioner of the RA.

Commissioners should demonstrate that they have at least five years’ relevant experience in administration, economics, law, and/or telecommunications.

Applications should be submitted to the Selection Committee, in writing and should include a curriculum vitae, applicant contact details, and at least three references in support of the application outlining key attributes relevant to the position.  Applications should be received no later than August 9, 2012.

Applications should be delivered to the Ministry of Environment, Planning and Infrastructure Strategy, 5th Floor, Dame Lois Browne Evans Building, 58 Court Street, HM 12 for the attention of the Permanent Secretary.

The Minister of Justice, in exercise of the powers conferred by section 2 of the International Sanctions Act 2003, makes the following Regulations:

Citation

1These Regulations may be cited as the International Sanctions (Sudan and South Sudan) (Restrictive Measures) Regulations 2012.

Application

2The Sudan and South Sudan (Restrictive Measures) (Overseas Territories) Order 2012 made by the Privy Council as a United Kingdom Order in Council on 15 February 2012 and any amendments to it, shall have the force of law in Bermuda.

Revocation

3The International Sanctions (Sudan) (Restrictive Measures) Regulations 2004 are revoked.
