BROADCASTING COMMISSION

The Broadcasting Commission has proposed to make substantial changes to the Films (Control of Exhibition) Act 1959. These proposed changes are intended to affect the classifications and approvals of films, the exhibition and distribution of films, video sales and rentals, and computer games to members of the public.

In this context, the Minister of Energy, Telecommunications and E-Commerce proposes that the provisions of the Ontario Legislation, the "Film Classification Act 2005, S.O. 2005, c. 17" and its subordinate regulations, the "Ontario Regulations 452/05" available online from http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_05f17_e.htm be adopted with the exception of the provision that allows the public exhibition of "Adult Sex Films". This aspect of public exhibition will continue to be deemed as undesirable in Bermuda and will be prohibited from public exhibition.

Of major importance, the Act will now require persons distributing or exhibiting film to be licensed and it will therefore have to establish a licensing application process that affords an applicant the right to Appeal. It will also allow for other forms of appeals should the Licence be suspended, revoked or be given other conditions not native to the current Licence.

The Broadcasting Commission established under the Broadcasting Commissioners Act 1973 will continue to be the authority under the amended Act. The Police and designated Inspectors from the Department of Telecommunications will be the authority to carry out inspections and to initiate criminal proceedings.
