Owners of fishing vessels who have not yet had their vessels inspected should come to the Licensing Office of the Department of Environmental Protection, Botanical Gardens, Paget by 5:00 p.m. TODAY Wednesday, March 31, 2010 to request a deferred inspection date from the Commercial Fisheries Council (CFC).

Fishing vessel licenses not renewed by TODAY will revert to the Department.

GRAND ATLANTIC RESORT AND RESIDENCES (WARWICK PARISH) SPECIAL DEVELOPMENT AMENDMENT ORDER 2010

The Minister responsible for planning, in exercise of the powers conferred by section 15(2)(a) of the Development and Planning Act 1974, makes the following Order:

Citation

1 This Order, which amends the Grand Atlantic Resort and Residences (Warwick Parish) Special Development Order 2007 ("the principal Order"), may be cited as the Grand Atlantic Resort and Residences (Warwick Parish) Special Development Amendment Order 2010.

Amends paragraph 2

2 Paragraph 2 of the principal Order is amended-

(a) by deleting the words "referred to in the planning application and more particularly" from the definition of "development"; and

(b) by deleting the definition of "planning application".

Amends paragraph 3

3 Paragraph 3 of the principal Order is amended-

(a) in the headnote by deleting the words "in principle";

(b) in subparagraph (1) by deleting the words "in principle";

(c) by deleting subparagraph 2(a) and substituting the following-

"(a) prior to submission of the application for a building permit for the affordable homes component, the applicant shall submit for the approval of the Minister of Environment and Sports, a comprehensive landscaping plan for the residential portion of the site;"; and

(d) by adding the following after subparagraph 2(c)-

"(ca) all affordable housing residential blocks shall be set back a minimum of 50 feet from the coastline in accordance with the Geotechnical Engineering Report;

(cb) prior to the submission of the application for a building permit for the hotel and related facilities, the applicant shall submit for the further approval of the Minister of Environment and Sports, comprehensive details of design and external appearance of the buildings and landscaping of the hotel portion of the site. Such plans shall include, but not be limited to, floor, elevations, building sections, site sections of the hotel, fractional units, commercial building and ancillary facilities such as swimming pools and decks;".

Amends First Schedule

4 The First Schedule to the principal Order is amended-

(a) by deleting paragraph 2 and substituting the following-

" 2 The hotel component will be a phased development with the first phase consisting of 85 to 100 guest rooms/suites, restaurant(s), spa, swimming pool(s), conference facilities, beach access and retail shops,";

(b) by deleting paragraph 4 and substituting the following-

"4 The construction of 125 new affordable homes comprised of 30 three-bedroom units of approximately 1,400 square feet and 95 two-bedroom units at approximately 1,100 square feet."; and

(c) by inserting the following as paragraph 4a-

"4a The construction of 20 new fractional suites at approximately 1,500 square feet.".

Amends Second Schedule

6. The Second Schedule to the principal Order is deleted and substituted with-

The Institute of Chartered Accountants of Bermuda, in exercise of the powers conferred on it by section 7 of the Institute of Chartered Accountants of Bermuda Act 1973, makes the following amendments to its By-Laws:

Citation

1 These By-Laws, which amend the Institute of Chartered Accountants of Bermuda By-Laws 2006 (the "principal By-Laws"), may be cited as the Institute of Chartered Accountants of Bermuda Amendments to By-Laws 2010.

Amends By-Law 5(1)(a)

2 By-Law 5(1)(a) of the principal By-Laws is amended by deleting the words "by-law 61" and replacing them with "the rules and regulations made under by-law 53".

Amends By-Law 18

3 By-Law 18 is amended by-

(a) repealing subsection (1) and replacing it with-

"(1) The affairs of the Institute shall be managed and conducted by a Council consisting of not less than eleven nor more than twenty individuals.";

(b) repealing subsection (2) and replacing it with-

"(2) A representative of the Canadian Institute of Chartered Accountants (the "CICA Representative") shall be an honorary member ex officio of the Council and the Institute, without fee. The CICA Representative shall be deemed not to be a member of the Council for the purposes of sections 4 and 5 of the Act and shall not have the right to vote on decisions of the Council.";

(c) in subsection (4) by deleting the word "eight" and replacing it with the words "sixty per cent";

(d) in sub-section (5) by deleting the words "the election of a member by";

(e) repealing subsection (6) and replacing it with-

"(6) No member of the Council may serve more than six consecutive terms on the Council.";

(f) in subsection (7) by adding next after the word "remuneration" the words ", provided that any member of the Council who is not a member of the Institute shall receive such remuneration as shall be determined from time to time by the Council."; and

(g) by inserting next after subsection (7) a new subsection (8) as follows-

"(8) Where there are less than two individuals who are not members of the Institute serving as members of the Council, the Council may co-opt up to two individuals who are not members of the Institute to serve as honorary members of the Council. Such honorary members shall be deemed not to be members of the Council for the purposes of sections 4 and 5 of the Act and shall not have the right to vote on decisions of the Council.".

The Minister responsible for health, in exercise of the power conferred by section 13A(4)(b) of the Bermuda Hospitals Board Act 1970, makes the following Order:

1 This Order may be cited as the Bermuda Hospitals Board (Medical and Dental Charges) Order 2010.

Interpretation

2 In this Order-

"specialist" means a person designated as such by the Medical Staff Committee of the Bermuda Hospitals Board;

"unit" means a unit in the scale of fees prepared by the Minister under section 13A(1) of the Bermuda Hospitals Board Act 1970.

Dollar value of units

3 For the purposes of section 13A(4)(b) of the Bermuda Hospitals Board Act 1970-

(a) in relation to the type of practitioner listed in the Schedule hereto, the dollar value of each unit shall be as set out in the Schedule; and

(b) in relation to a dental practitioner, the dollar value of units shall be calculated in accordance with the Ontario Dental Association 2010 Fee Schedule.

Revocation of BR 50/2008

4 The Bermuda Hospitals Board (Medical and Dental Charges) Order 2008 is revoked.

1 This Order may be cited as the Health Insurance (Health Insurance Plan) (Premium) Order 2010.

Premium

2 The premium (including the standard premium) to be paid to the Committee in respect of each health insurance plan effected with the Committee under the Act shall be $298.93 a month (or $68.98 a week where paid weekly).

3 The Health Insurance (Health Insurance Plan) (Premium) Order 1987 is revoked.

Commencement

4 This Order comes into operation on 1 April 2010.

HEALTH INSURANCE (STANDARD HOSPITAL BENEFIT) AMENDMENT

REGULATIONS 2010

The Minister responsible for health, acting on the recommendations of the Bermuda Health Council, in exercise of the power conferred by section 40(1) of the Health Insurance Act 1970, makes the following Regulations:

Citation

1 These Regulations, which amend the Health Insurance (Standard Hospital Benefit) Regulations 1971 ("the principal Regulations"), may be cited as the Health Insurance (Standard Hospital Benefit) Amendment Regulations 2010.

Inserts regulation A1

2 The principal Regulations are amended by, immediately before regulation 1, inserting the following-

"Interpretation

A1 In these Regulations-

"Act" means the Health Insurance Act 1970;

"compulsorily insurable" in relation to any person, means a person in respect of whom an employer is required to effect a contract of health insurance in pursuance of section 20 of the Health Insurance Act 1970.".

Amends regulation 3

3 Regulation 3 of the principal Regulations is amended by repealing subparagraph (aa) of paragraph (xxxviii).

Inserts regulations 9 to 12

4 The principal Regulations are amended by, immediately after regulation 8, inserting the following-

"Standard premium

9 Subject to regulation 10, the standard premium payable in respect of the standard hospital benefit shall be $236.14 a month (or $54.49 a week where paid weekly) of which $26.51 a month (or $6.12 a week) shall be paid into the Mutual Re-Insurance Fund.

Standard premium for persons over 65

10 The standard premium payable in respect of the standard hospital benefit for persons over the age of sixty-five years who do not qualify for subsidised hospital treatment under section 2(1)(b) and (bb) of the Act shall be $865.03 a month (or $199.62 a week) of which $26.51 a month (or $6.12 a week) shall be paid into the Mutual Re-Insurance Fund.

Employer entitled to deduct half of standard premium

11 (1) Where an employer has effected a contract of health insurance in respect of an employee in pursuance of section 20 of the Act, the employer is entitled to make the following deductions (being one half of the amount of the standard premium payable in respect of the period) from the salary, wages or other remuneration payable to that employee-

(a) in the case of an employee, other than an employee who is over the age of 65 years and who does not qualify for subsidised hospital treatment under section 2(1)(b) or (bb) of the Act-

(i) where the employee is paid monthly, at a rate not exceeding $118.07 per month; or

(ii) where the employee is paid weekly, at a rate not exceeding $27.25 per week; or

(b) in the case of an employee who is over the age of 65 years and who does not qualify for subsidised hospital treatment under section 2(1)(b) or (bb) of the Act-

(i) where the employee is paid monthly, at a rate not exceeding $432.52 per month; or

(ii) where the employee is paid weekly, at a rate not exceeding $99.81 per week.

(2) Paragraph (1) shall apply mutatis mutandis to a contract of health insurance effected in respect of the non-employed spouse of an employee.

Deductions on termination of employment

12 (1) Where during the course of a month, an employee ceases to be compulsorily insurable by any employer by virtue of the termination of the employee's employment, the employer is entitled to make the following deductions from the salary, wages, or other remuneration payable to that employee-

(a) in the case of an employee, other than an employee who is over the age of 65 years and who does not qualify for subsidised hospital treatment under section 2(1)(b) or (bb) of the Act, at a rate not exceeding $27.25 for each week or part of a week for which the employee has been employed during that month and for any period of extended cover for which the employer is liable to pay a premium in pursuance of regulation 5 of the Health Insurance (Cover) Regulations 1971; or

(b) in the case of an employee who is over the age of 65 years and who does not qualify for subsidised hospital treatment under section 2(1)(b) or (bb) of the Act, at a rate not exceeding $99.81 for each week or part of a week for which the employee has been employed during that month and for any period of extended cover for which the employer is liable to pay a premium in pursuance of regulation 5 of the Health Insurance (Cover) Regulations 1971.

(2) Paragraph (1) shall apply mutatis mutandis to deductions in respect of a non-employed spouse who ceases to be compulsorily insurable by his or her spouse's employer.".

5 The Health Insurance (Standard Premium) Regulations 2009 and the Health Insurance (Deductions) Regulations 1971 are revoked.

Commencement

6 These Regulations come into operation on 1 April 2010.

HEALTH INSURANCE (STATISTICAL REPORTS) REGULATIONS 2010

The Minister responsible for health, acting on the recommendations of the Bermuda Health Council, in exercise of the power conferred by section 40(1) of the Health Insurance Act 1970, makes the following Regulations:

Citation

1 These Regulations may be cited as the Health Insurance (Statistical Reports)

Regulations 2010.

2 Annual statistical returns by licensed health insurers Each licensed insurer shall, not later than the 31st day of August in each year, furnish to the Council, in such form as the Council shall determine, a statistical report in respect of insurance business transacted by that insurer in the twelve months ending on the 31st day of the preceding March.

Annual statistical returns by employers

3 Each employer who operates an approved scheme shall, not later than the 31st day of August in each year, furnish to the Council, in such form as the Council shall determine, a statistical report in respect of the operation of the approved scheme in the twelve months ending on the 31st day of the preceding March.

Revokes BR 15/1986

4 The Health Insurance (Statistical Reports) Regulations 1986 are revoked.

Commencement

5 These Regulations come into operation on 1 April 2010.

INSURANCE ACCOUNTS AMENDMENT REGULATIONS 2010

The Minister of Finance, in exercise of the power conferred by section 53 of the Insurance Act 1978, makes the following Regulations:

Citation

1 These Regulations may be cited as the Insurance Accounts Amendment Regulations 2010.

Interpretation

2 In these Regulations "principal Regulations" means the Insurance Accounts Regulations 1980.

Schedule I to principal Regulations amended

3 Form 1A of Schedule I to the principal Regulations is amended by deleting paragraph 28 and substituting the following-

"28. Insurance and Reinsurance Balances Payable xxx xxx".

Schedule II to principal Regulations amended

4 Part V of Schedule II to the principal Regulations is amended-

(a) by deleting paragraph 13 "Sundry assets" and substituting the following-

"13. Sundry assets (a) The nature and terms of these assets.

(b) For derivatives and embedded derivatives, if any, the following must be disclosed-

(i) a description of the policies surrounding the use of derivatives; and

(ii) market value and nominal exposure of each derivative by issuer with nominal exposure greater than 5% of the aggregate sum of the total quoted and unquoted investments. Disclosure should be separated between long and short positions."

(b) by deleting paragraph 36 "Sundry liabilities" and substituting the following-

"36. Sundry

liabilities (a) The nature of these liabilities and the repayment terms;

(b) For derivatives and embedded derivatives, if any, the following must be disclosed-

(i) a description of the policies surrounding the use of derivatives; and

The Minister responsible for Maritime Administration, in exercise of the powers conferred by section 6 of the Merchant Shipping Act 2002, makes the following Order:

1 This Order may be cited as the Merchant Shipping (Deep Panuke Gas Production Platform) (Exemption) Order 2010.

Exempted Gas Production Platform from certain provisions and regulations

2 The drill rig known as the "Deep Panuke", which will operate in an area approximately 173 km offshore of the Province of Nova Scotia, Canada, in the vicinity of and to the west south west of Sable Island, is exempt from the following provisions of the Act and regulations made thereunder-

(a) sections 26 and 33 of Part IV (relating to tonnage measurement);

(b) Part V (Masters and Seamen);

(c) Part VI (Safety)

(d) Part VII (Prevention of Pollution);

(e) Part VIII (Liability of Ship-owners);

(f) Part IX (Salvage and Wreck);

(g) Merchant Shipping (Load Line) Regulations 1998;

(h) Merchant Shipping (Tonnage) Regulations 2008; and

(i) Merchant Shipping (Registration of Ships) Regulations 2003, section 19 (relating to the survey and measurement of a ship).

Duration of Order

3 This Order ceases to be in force on a day to be fixed by the Minister responsible for Maritime Operations by Order in the Official Gazette.

Commencement

4 This Order shall come into operation on the date that it appears in the Official Gazatte.

HEALTH INSURANCE (FUTURECARE PLAN) (PREMIUM) ORDER 2010

The Minister responsible for health, in exercise of the power conferred by section 13B of the Health Insurance Act 1970, makes the following Order:

Citation

1 This Order may be cited as the Health Insurance (FutureCare Plan) (Premium) Order 2010.

Premium for persons who qualify for subsidy

2 The premium (including the standard premium) to be paid to the Committee in respect of each FutureCare plan effected with the Committee under the Act for persons over the age of 65 who qualify for subsidised hospital treatment under section 2(1) of the Act shall be-

(a) in the case of a person who was enrolled in the FutureCare plan immediately before 1 April 2010, $300.00 a month (or $69.23 a week where paid weekly);

(b) in the case of a person who was not enrolled in the FutureCare plan immediately before 1 April 2010, and who attained the age of 65 years after 1 January 2009 but before 1 April 2010, $300.00 a month (or $69.23 a week where paid weekly);

(c) in the case of a person who was not enrolled in the FutureCare plan immediately before 1 April 2010, and who attains the age of 65 years on or after 1 April 2010, $600.00 a month (or $138.46 a week where paid weekly); and

(d) in the case of a person who was not enrolled in the FutureCare plan immediately before 1 April 2010, and who has attained the age of 70 years, $600.00 a month (or $138.46 a week where paid weekly).

Premium for persons who do not qualify for subsidy

3 The premium (including the standard premium) to be paid to the Committee in respect of each FutureCare plan effected with the Committee under the Act for persons over the age of 65 who do not qualify for subsidised hospital treatment under section 2(1) of the Act shall be $813.00 a month (or $187.62 a week where paid weekly).

Revokes BR 25/2009

4 The Health Insurance (FutureCare Plan) (Premium) Order 2009 is revoked.

Commencement

5 This Order comes into operation on 1 April 2010.

CEMETERY ROAD, PEMBROKE PARISH

ROAD CLOSURE

The Ministry of Works and Engineering wishes to inform motorists that there will be a road closure from the entrance of Gorham's Limited to the entrance of Animal Garden House on Cemetery Road.

The road closure will be in effect from Monday, 5th April, 2010 to Monday, 31st May, 2010 and is necessary to allow BELCO to undertake upgrades to their power plant.

During this time, business owners and residents along Cemetery Road will still be permitted to access their properties while patrons wishing to access businesses along Cemetery Road can do so via St. John's Road or Serpentine Road.

The Ministry of Works and Engineering apologizes for any inconvenience that may result from this road closure and requests the full cooperation of the motoring public.
